Under the 2015 Regulations, the Minister may revoke, refuse to make, or refuse to grant, as the case may be, a residence card where the right, entitlement or status being claimed is based on fraud or abuse of rights.

Where the Minister suspects, on reasonable grounds, that a right, entitlement or status is being claimed or has been obtained through fraud or abuse of rights, the Minister may carry out enquiries and obtain any information reasonably necessary to investigate the matter.

Before revoking a residence card, the Minister must give written notice to the person concerned, outlining the reasons for the proposal and allowing 21 days to provide an explanation or supporting submissions before a final decision is made.

Review Process

A review request must normally be submitted within 15 working days of receiving the decision.
